Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ArtKeeps mobile application and website at artkeeps.com, operated by Visoft Inc. ("Visoft," "we," "us," or "our"). By creating an account or using ArtKeeps, you agree to these Terms. If you do not agree, do not use the service.

1. Eligibility

You must be at least 13 years old to create an ArtKeeps account. By using the app, you confirm you meet this requirement. If you are creating an account on behalf of a child, you represent that you are the parent or legal guardian of that child.

2. Your Account

You are responsible for maintaining the security of your account. ArtKeeps uses email magic-code authentication — keep your email account secure. You are responsible for all activity that occurs under your account.

You may not share your account with others or transfer it to another person. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions and Billing

ArtKeeps offers a free tier and an optional ArtKeeps Pro subscription ("Subscription") that unlocks additional features. Subscriptions are billed on a recurring basis (monthly or annually) through Apple's App Store or Google Play. Pricing is displayed in the app before purchase.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• You can manage or cancel your Subscription in your device's App Store or Play Store account settings.
• Refunds are handled according to Apple's or Google's refund policies.
• We reserve the right to change Subscription pricing with reasonable advance notice.

All purchases of digital content and Subscriptions are processed through Apple or Google and are subject to their respective terms.

4. Your Content

You retain ownership of all artwork photos, descriptions, and other content you upload to ArtKeeps ("Your Content"). By uploading content, you grant Visoft Inc. a limited, non-exclusive, royalty-free license to store, display, and transmit Your Content solely to operate and provide the service to you and the family members you invite.

You are responsible for Your Content. You represent and warrant that:

• You have all rights necessary to upload and share Your Content.
• Your Content does not violate any applicable law or third-party rights.
• Your Content does not include anything harmful, illegal, or obscene.

5. Acceptable Use

You agree not to:

• Use ArtKeeps for any unlawful purpose or in violation of these Terms.
• Upload content you do not have the right to share.
• Attempt to gain unauthorized access to any part of the service or its systems.
• Interfere with or disrupt the service or servers connected to it.
• Use the service to harass, abuse, or harm others.
• Reverse-engineer, decompile, or disassemble any part of the app.

6. Intellectual Property

The ArtKeeps app, website, logo, and all associated software and content created by Visoft Inc. are owned by or licensed to Visoft Inc. and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without our written permission.

7. Termination

You may stop using ArtKeeps at any time and delete your account from Settings → Delete Account. Upon account deletion, your data will be removed within 30 days.

We may suspend or terminate your access to ArtKeeps at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the service. If we terminate your account without cause, we will provide a prorated refund of any unused prepaid Subscription period.

8. Disclaimers

ArtKeeps is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. We are not responsible for the loss of any content stored on the service; we strongly encourage you to maintain local copies of photos that are important to you.

9. Limitation of Liability

To the maximum extent permitted by law, Visoft Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of ArtKeeps, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or related to these Terms or the service will not exceed the amount you paid us in the twelve months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will provide notice in the app or by email. Continued use of ArtKeeps after changes are posted constitutes your acceptance of the updated Terms.
