Terms of Service

Effective date: October 1, 2026

These Terms of Service ("Terms") govern your access to and use of the ArtKeeps mobile application and website at artkeeps.com, operated by Visoft Inc. ("Visoft," "we," "us," or "our"). By creating an account or using ArtKeeps, you agree to these Terms. If you do not agree, do not use the service.

1. Eligibility

You must be at least 13 years old to create an ArtKeeps account. By using the app, you confirm you meet this requirement. ArtKeeps accounts are for parents and guardians, not children. If you add a child's information or artwork to ArtKeeps, you represent that you are that child's parent or legal guardian, or are otherwise authorized to do so.

2. Your Account

You are responsible for maintaining the security of your account. ArtKeeps uses email magic-code authentication — keep your email account secure. You are responsible for all activity that occurs under your account.

You may not share your account with others or transfer it to another person. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions and Billing

ArtKeeps offers a free tier and an optional ArtKeeps Pro subscription ("Subscription") that unlocks additional features. Subscriptions are billed on a recurring basis (monthly or annually) through Apple's App Store or Google Play. The price, billing period, and any free trial or introductory offer are displayed in the app before you purchase. Any unused portion of a free trial may be forfeited when you purchase a Subscription.

  • Subscriptions automatically renew for the same period at the then-current price unless you cancel. On Apple's App Store, cancel at least 24 hours before the end of the current period. On Google Play, cancel before the renewal date shown in your Play Store subscription settings.
  • Your account is charged to your Apple ID or Google account at confirmation of purchase and again at each renewal. You can manage or cancel your Subscription in your device's App Store or Google Play account settings. Deleting your ArtKeeps account or the app does not cancel your Subscription.
  • Refunds are handled by Apple or Google according to their refund policies. We cannot issue refunds for purchases made through those stores.
  • We may change Subscription pricing with reasonable advance notice. Price changes take effect at your next renewal and are subject to Apple's and Google's rules, which may require your consent.

All purchases of digital content and Subscriptions are processed through Apple or Google and are subject to their respective terms.

4. Your Content

You retain ownership of all artwork photos, descriptions, comments, reactions, and other content you upload or post to ArtKeeps ("Your Content"). By uploading content, you grant Visoft Inc. a limited, non-exclusive, royalty-free license to store, display, and transmit Your Content solely to operate and provide the service to you and the family members you invite.

You are responsible for Your Content. You represent and warrant that:

  • You have all rights necessary to upload and share Your Content.
  • Your Content does not violate any applicable law or third-party rights.
  • Your Content does not include anything harmful, illegal, or obscene.
  • If Your Content includes images or information about a child, you are that child's parent or legal guardian or are authorized to share it.

5. Acceptable Use

You agree not to:

  • Use ArtKeeps for any unlawful purpose or in violation of these Terms.
  • Upload content you do not have the right to share.
  • Attempt to gain unauthorized access to any part of the service or its systems.
  • Interfere with or disrupt the service or servers connected to it.
  • Use the service, including comments and reactions, to harass, abuse, threaten, or harm others.
  • Post comments or other content that is unlawful, hateful, sexually explicit, or that infringes someone else's rights.
  • Reverse-engineer, decompile, or disassemble any part of the app.

If you believe content in ArtKeeps infringes your rights or violates these Terms, contact us at support@visoftinc.com. We may remove content (including comments) or suspend accounts in response to reports or if we believe content violates these Terms, and we respond to valid copyright notices. Content shared with family members is visible to the people the account holder invites; the account holder is responsible for whom they invite, and each person is responsible for what they post.

6. Intellectual Property

The ArtKeeps app, website, logo, and all associated software and content created by Visoft Inc. are owned by or licensed to Visoft Inc. and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without our written permission.

7. Termination

You may stop using ArtKeeps at any time and delete your account from Settings → Delete Account. Upon account deletion, your data will be removed within 30 days, although copies may remain in backups for up to 90 days as described in our Privacy Policy.

We may suspend or terminate your access to ArtKeeps at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the service. If we terminate your account without cause, we will make reasonable efforts to compensate you for the unused portion of any prepaid Subscription period, for example by extending your access or supporting your refund request with Apple or Google. Refunds for purchases made through those stores are issued only by Apple or Google under their policies.

8. Disclaimers

ARTKEEPS IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY LAW.

We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. We work to keep your content safe, but we cannot guarantee that it will never be lost or corrupted. We strongly encourage you to keep the original artwork and local copies of photos that are important to you.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISOFT INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF ARTKEEPS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR US$50. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, including for fraud, gross negligence, or willful misconduct, or any consumer rights you have under the laws where you live.

10. Governing Law

These Terms are governed by the laws of the State of Connecticut, United States, without regard to its conflict of law provisions. Any disputes will be resolved in the state or federal courts located in Connecticut, and you consent to personal jurisdiction in those courts. If you are a consumer, this section does not remove any right you have under the mandatory laws of the place where you live, including the right to bring a claim in your local courts where the law gives you that right.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will provide notice in the app or by email. Continued use of ArtKeeps after changes are posted constitutes your acceptance of the updated Terms.

12. General

These Terms, together with our Privacy Policy, are the entire agreement between you and Visoft regarding ArtKeeps. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Your purchases through Apple or Google are also subject to their terms.
